General Workshop Series Goals (This Course is NBCC Approved)


This interactive workshop focuses on the major elements of legal and ethical issues surrounding counselors in working with patients who have substance use disorders.  In this workshop, participants will learn about the different areas of legal and ethical concern for today’s counselors working with clients who have both mental health and substance use issues.  Legal areas include scope of clinical practice, malpractice, duty to warn, direct and vicarious liability, informed consent, confidentiality, and working within the parameters of ADA.  Ethical areas covered include workplace harassment, dual relationships, ethical decision making and common ethical issues reported by counselors.  Differences in certain standards by different mental health and substance use professions will be discussed. Teaching methods include lecture, interactive exercises and group participation/discussion.


Legal Standards and Ethical Issues in Substance Use Counseling (5 NBCC Clock Hours)
Workshop Components:
8:30am - Sign in/Morning Coffee Station

I              Malpractice (15 Minutes):  9 a.m. – 9:15 a.m.         

  1. What is needed to prove malpractice.
  2. How to reduce legal liability.

II             Duty to Warn (45 Minutes):  9:15 a.m. – 10 a.m.

  1. Duty to warn defined.
  2. NJ Legal Standards regarding duty to warn.
  3. Imminent Danger Defined.
  4. Supervisor and supervisee issues surrounding duty to warn.
  5. NBCC and ACA on Duty to Warn.
  6. Duty to warn interactive group exercises. 

III            Ethical Decision Making and Ethical Theory (30 Minutes):  10 a.m. – 10:30 a.m.

  1. Ethical Decision Making.
  2. Intrapsychic Theory of Ethical Decision Making.
  3. Social Interaction Theory of Ethical Decision Making.
  4. Most common ethical complaints against therapists. 

Morning Break:  10:30 a.m. – 10:45 a.m.

IV            Informed Consent (30 Minutes): 10:45 a.m. – 11:15 a.m. 

  1. Parameters of informed consent.
  2. NJ DCA LCADC/CADC informed consent standards.
  3. Informed consent interactive group exercise.

V             Confidentiality (45 Minutes):  11:15 a.m. – 12 p.m.

  1. Confidentiality defined. Specific issues to 42-CFR-Part2 updated in 2017.
  2. General confidentiality issues and how this impacts the counselor and the supervisor.
  3. Exceptions to confidentiality.
  4. Confidentiality interactive group exercise.
  5. NJ LCADC/CADC Division of Consumer Affairs confidentiality standards.

Lunch Break:  12 p.m. – 1 p.m. 

VI            Record Keeping (30 Minutes): 1 p.m. – 1:30 p.m.

  1. Types of clinical record keeping.  
  2. Clients access to their own records.
  3. NJ LCADC/CADC Division of Consumer Affairs record keeping standards.
  4. Record keeping group exercise. 

VII          ADA and Anti-discrimination Standards (30 Minutes): 1:30 p.m. – 2 p.m.

  1. Americans with Disabilities Act.
  2. Substance Abuse Standards in Regards to ADA.
  3. The Concept of Reasonable Accommodation.
  4. The Concept of Financial and/or Resource Undue Hardship.
  5. ADA interactive group exercise. 

Afternoon break 2 p.m. – 2:15 p.m.

VIII         Dual Relationships (30 Minutes):  2:15 p.m. – 2:45 p.m. 

  1. What makes a dual relationship unethical?
  2. Sexual and Non-sexual dual relationships.
  3. Dual relationship interactive group exercise.

IX           Workplace Harassment (45 Minutes): 2:45 p.m. – 3:30 p.m.

  1. Definition of Workplace Harassment.
  2. Definition of Sexual Harassment.
  3. NJ LCADC/CADC Division of Consumer Affairs harassment and sexual harassment standards.
  4. Different licensures standards and group ethical standards and how they handle dual relationships with clients.
  5. Issues and Responses Necessary in a Workplace Harassment Scenario.

Cancellation/Reimbursement Policy:  Valid requests must be received in writing/email within seven (7) days of course date.  Late requests for the 4 day workshop series can only bring in a substitute attendee
or receive credit for a future workshop date.  All refunds are subject to a $15.00 processing fee.  If paid by credit card, an additional $4.04 fee will be assessed to cover the cost of PayPal processing charges on credit cards.
Refund requests require 2-3 weeks processing time and will be issued as a check as is our policy.
